Violence against PEACEFUL ASSEMBLY will be punished by ICC

This is a landmark judgement that Malaysia should take notice of. It
is not just murder, but also persecution of civilians doing their
democratic right of PEACEFUL ASSEMBLY.
Judgement issued by ICC:
The statement, read out by presiding judge Sanji Monageng, said there
were "reasonable grounds to believe" that the three men were
"criminally responsible" for the murder and persecution of civilians.
As the "recognised and undisputed leader of Libya", said the court,
Col Gaddafi had "absolute, ultimate and unquestioned control" over the
state.
He introduced a state policy "aimed at deterring and quelling by any
means, including by the use of force, the demonstrations of civilians
against the regime", the court alleged.

The International Criminal Court has issued an arrest warrant for
Libyan leader Col Muammar Gaddafi, accusing him of crimes against
humanity.
The court had grounds to believe he had ordered attacks on civilians
during Libya's four-month uprising, it said.
The Hague-based court also issued warrants for two of Col Gaddafi's
top aides - his son Saif al-Islam and intelligence chief Abdullah al-
Sanussi.
Thousands of people are believed to have been killed in the conflict.
Anti-Gaddafi forces said on Monday they had launched a new push
towards Tripoli. there has been heavy fighting near the strategic town
of Bir al-Ghanam, to the south-west of capital.
The rebel defence minister told the BBC that forces opposed to Col
Gaddafi may also make a move on the capital from the east.
'Unquestioned control'
The ICC arrest warrants refer to early weeks of the uprising, from 15
February until "at least 28 February".

The warrant says that while Saif al-Islam Gaddafi holds no official
position in Libya, he is "the most influential person" in Col
Gaddafi's inner circle.
Mr Sanussi, said the court, had "indirectly instructed the troops to
attack civilians demonstrating" in Benghazi, the city that has become
the rebels' stronghold.
The BBC's Andrew Harding in Misrata said there was celebratory gunfire
on the streets of the besieged city as the news emerged.
'No legitimacy'
The warrants had been requested by chief ICC prosecutor Luis Moreno-
Ocampo in May. He has said Col Gaddafi must be arrested in order to
protect civilians.

Analysis
image of Andrew Harding Andrew Harding BBC News, Misrata
There were celebrations across Misrata today, with car horns beeping,
and a lot of gunfire in the air as people greeted the news from the
ICC.
This still besieged city has suffered a great deal at the hands of Col
Gaddafi's forces, which have pounded the city itself and killed many
civilians.
A lot of people I've been speaking to say they believe Col Gaddafi
should face justice in the Hague. But, when pressed, many people also
say that if his internal or external exile or house arrest would end
this war quicker, they'd be happy to accept that.
* Misrata: 100 days of bombing
But the Libyan authorities have previously said they do not recognise
the court and are not concerned by the threat of a warrant.
On Sunday, government spokesman Moussa Ibrahim said the court was
overly preoccupied with pursuing African leaders and had "no
legitimacy whatsoever".
But the arrest warrant was welcomed by UK Foreign Secretary William
Hague, who said it further demonstrated "why Gaddafi has lost all
legitimacy and why he should go immediately".
Mr Hague called on people within the Libyan regime to abandon the
leader and said those responsible for "atrocities" must be held to
account.
The ICC announcement comes as the international air operation in
Libya, aimed at protecting civilians, enters its 100th day.

EC powerless to remove clear Phantom Voters' in MP's house???

A dark day for Malaysian indeed. Maybe it is too late for Malaysian
democracy.
We are going into the era of Libya and Egypt. We can forget about
reaching a developed nation status.
http://www.malaysiakini.com/news/167980
The Election Commission (EC) has admitted a major error by allowing
six individuals to be wrongfully registered with the address of the
house belonging to Gombak MP Azmin Ali's mother, but appears to have
little power to rectify the problem.

Janganlah kita membelit belit kan bahasa sehingga menyatakan bahawa
setelah masuk Islam, BOLEH DIPAKSA pula!!!

Biarlah mereka masuk NERAKA.
JANJI.

Berbohong pula itu. Bada sendiri PERLEMBAGAAN!!!
Jelas betul " RAKYAT BEBAS BERHIMPUN SECARA AMAN"

Bagaiman boleh BEBAS kalau POLIS MELARANG SEBARANG PERHIMPUNAN!!!!

Sebab KONONNYA AKAN BERLAKU TIDAK AMAN!!

Bagaimana dia tahu SEBELUM PERHIMPUNAN berlaku!!!!

wang.

Orang Melayu mesti selidiki siapa Ambiga

2011/06/26
Ambiga Sreenevasan
Ambiga Sreenevasan
Perhimpunan haram dianjur individu perlekeh Islam

KUALA LUMPUR: Rakyat Malaysia, terutama orang Melayu diminta meneliti
siapa sebenarnya Datuk Ambiga Sreenevasan sebelum mengikut telunjuknya
menerima memorandum menuntut pelaksanaan Suruhanjaya Antara Agama

agama Islam.

Beliau turut mengadakan forum mengenai memeluk agama Islam pada 9 Ogos
2008 yang membincang dan mempertikaikan secara terbuka Perkara 121
(1A). Biarpun mendapat bantahan orang Islam, Majlis Peguam yang
diterajui Ambiga tetap meneruskan forum itu.

Justeru penganalisis politik berpendapat tindak tanduk Ambiga

walaupun mendapat bantahan pelbagai pihak," katanya.

elektronik, bukannya mengadakan demonstrasi haram.

patut menjadi pemimpin, termasuk Ambiga.

Katanya, mereka terlampau mengikut parti politik tertentu yang
memperjuangkan ideologi politik masing-masing sedangkan mereka sendiri

perjuangan asal mereka," katanya.

kepentingan kekuasaan mereka sendiri, katanya. – BERNAMA

Proof that Malaysia does not respect democracy

The Malaysian constitution clearly states that there is a right to
PEACEFUL ASSEMBLY.

You can add additional verses after this, if it does not support the
meaning of the PEACEFUL ASSEMBLY it is not in accordance with this
constitution.

As Muslims it is particularly very important to respect the
constitution because it is a written promise that must be kept and
respected. Anyone breaking this written promise will be severely
punished but allowing people to break this promise is even worse, you
become NON-MUSLIMS.

Prophet Muhammad clearly states: Stop unrighteous deeds with your
hands if possible, with voice if not able, or just protest silently,
but this is the worst of FAITH. So if you support bad deeds, you have
NO FAITH, i.e. out of ISLAM.

So anyone, who threatens to stop people in wanting to assert their
right to PEACEFUL ASSEMBLY guaranteed by a written constitution, are
not MUSLIMS. As non-Muslims, they do not deserve to be called Malays,
because they are animals, and to be a Malay, you must be a Muslim,
i.e. a follower of Prophet Muhammad.

Are we blind to note that opposition parties, who are REAL MALAYS,
because they are true Muslims, unlike the infidel UMNO, have won many
seats in the recent elections, but these are despite all the UNFAIR
and ILLEGAL. In all law abiding nations, it should have meant that
automatically the cheater, i.e. the BN, are disqualified and should
not have been allowed to rule.

At the least, the REAL MALAY opposition parties in PAS, and PKR,
should have won many more seats to allow them to RULE many more states
and the NATION itself. Are you so blind to this fact and reality???

And then, ARE YOU BLIND TO the reality that if THERE WERE NO ELECTION
CHEATING, people will not threaten VIOLENTLY the people who simply
demand that the cheating be stopped!!! Just let them shout to their
hearts' contents. The truth will win eventually.

But NO! People are threatened with DEATHS, just to ASSEMBLE PEACEFULLY
to protest about ELECTION CHEATING!!!
What proof DO YOU WANT ANY MORE?? They are surely cheating, that is
why they are so worried.

These ELECTION CHEATERS are CRIMINALS similar to MURDERERS.

Do you want to let murderers GOVERN YOU!!!!

We must stand together to fight against murderers. At least for
Muslims, it is to show that WE STILL HAVE FAITH IN ISLAM, which is not
just for the hereafter but also for the worldly lives. We WANT TO
ENJOY OUR LIVE in this earth, not to suffer the indignity of POVERTY
or lost opportunities to enjoy the RESOURCES THAT GOD HAVE GIVEN TO
US.

Because time after time, it is proven that if you let murderers govern
over you, you will SUFFER FULLY. Just like Malaysia, as clearly shown
by SABAH. Despite having so much resources and peaceful people, it is
the POOREST and MOST VIOLENT, in the whole WORLD.

Whereas Singapore and Japan, the nations with the least resources, are
the RICHEST AND MOST PEACEFUL, in the whole world. Their secrets are
very simple. They do not let MURDERERS to rule them. They enforce
their laws and constitution thoroughly.

Malaysians must stand up againt CRIMINALS. Restore our democracy to
ensure peace and prosperity, now and hereafter.

What more proof do you want???

An anti-Bersih supporter has threatened its chairman with her life if
the rally takes place.
UPDATED

PETALING JAYA: Bersih 2.0 chairperson, Ambiga Sreenevasan, has been
warned that her life is at stake if the "Walk for Democracy" rally
proceeds on July 9.

In a text message sent to Ambiga and the press at 1.57am this morning,
the unknown sender said, "If the rally takes place my people and I
will kill Ambiga and all those around her one by one including the
idiot politicians who are in cahoots with this infidel. This is my
warning. You watch out."

The text was written in Malay and some FMT reporters have also
received it. But it isn't clear whether any members of the public have
also got it.

The sender also questioned if the people were blind in that they
didn't see that Ambiga was being used as a tool to destroy Malay
unity.

"The PAS and PKR camps are are both deaf and blind. If the Election
Commission wasn't clean, could they have won Selangor, Kedah, Penang,
Kelantan and Perak?"

The sender also slammed DAP and called it "Cina sial" for standing on
the sidelines while the Malays were at each other's throats.

"At the end of the day, DAP will rule this country and turn all of us
into Christians. Mark my words."

In a text message to FMT, Ambiga said, "Yes many members of the media
have received this. So have I. Am making a police report."

The Home Ministry yesterday said that police permits will not be
issued to Bersih 2.0, Umno Youth and Perkasa to conduct mass
gatherings and marches on July 9.

At least 422 police reports have so far been lodged against the rally
and its organisers condemning it as a plot to overturn the government.

Perkasa and Gerak Aman, a coalition of 57 NGOs, have announced that
they will counter the Bersih rally. Umno Youth, meanwhile, is
organising a march on the same day to hand over a memorandum to the
Yang di-Pertuan Agong.

Mad dog barking

Meanwhile a member of the Bersih steering committee, Wong Chin Huat,
who also received the text last night, reiterated Bersih's
determination to carry on with the rally.

"It shows that they are cowards," he told FMT. "They know they cannot
win with reason so they have to resort to this which further proves
that dirty elections are backed by violence."

Wong acknowledged that the text would probably spark anxiety among
ordinary Malaysians but called on them not to back down from making a
stand on July 9.

"What do you do if a mad dog is barking at you?" he asked. "If you run
you get bitten from behind. If you stand your ground, the dog may have
to eventually back off."

"If Malaysians back down because of threats of violence, we will never
be safe because we have given a victory to thugs. Even if you disagree
with Bersih and support dirty elections, you should never support
violence."

Wong added that the coalition was taking the threat very seriously but
assured that they were neither paranoid nor fearful.

"None of these things will stop us," he said. "We believe that enough
Malaysians will stand by us."

Biometrics will not stop Malaysian Phantom Voters

Using boimetrics proposed by the EC will not solve this Malaysian
Phantom Voters because even now their ICs have already been verified.
If you vote twice, using the same IC number, you will be detected.

The Phantom voters exist because they are issued many ICs to vote at
different places. the ICs issued are those that do not vote at a
particular day. Only the registration department and EC can do this,
or machines available at the registration department and EC, which are
used to create these temporary ICs.

Only indelible ink will solve the problem of phantom voters. It may
not solve the problem of illegal voters but it will allow Malaysians
to know who actually had voted. This is why BN government had feared
the most.

This is common knowledge. If you don't know about it, you are just
pathetic and don't care, and we all deserve the fate that we suffer
now. Substandard roads, acute poverty, insufficient development rate
due to leakages and corruption.

This proposed biometric test is just a screen to fool the pathetic
idiots. Also to earn extra cash for BN supporters.
EC violations of the constitution makes it a criminal organisation
that do not deserve any support from all concerned citizens. Allowing
election corruption in daylight in the form of illegal media coverage
for the incumbent party, the BN, is proof enough that EC is a criminal
organisation. What more proof do you want? Allowing only 7-days for
campaigning is also an example how criminal EC is? the constitution
does not allow unfair election practises and the EC has allowed such
blatant illegal and unconstitutional and corrupt election practises.

Do you trust the EC with the biometric system instead of the simpler,
more effective, more transparent, and already paid for INDELIBLE
INK!!!!

EC Plans Using Biometric System In Coming General Election

PUTRAJAYA, June 20 (Bernama) -- The Election Commission (EC) plans to
use the biometric system to enable the verification of voters in the
coming general election to be done electronically, said its chairman
Tan Sri Abdul Aziz Mohd Yusof.

He said the EC would cooperate with the Home Ministry in using the
system which was now being used by the ministry to verify foreigners.

"The same principle shall apply, but the system to be used on voters,"
he told reporters at his office, here, today.

He was reacting to one of the eight demands made by Bersih or the
nuisance group which wants to hold an illegal rally to ensure a
transparent and clean election, namely the use of indelible ink on
voters' finger.

The Immigration Department is currently using the biometric system at
all the country's entry/exit points to curb international crime and
the influx of illegal immigrants.

Abdul Aziz said: "By using biometric prior to issuing the ballot
paper, the first step to be taken is to verify the identity card to
prove that it is a genuine document.

"The bearer of the identity card needs to place his or her thumb on
the device, and the information that appears on the screen will be the
same as on his/her IC.

"Once verified, we will check whether the voter's name is in the
electoral roll. If it is there, we will issue the ballot paper.

"Then he will be considered to have voted, and the individual
concerned cannot go to other polling station with the identity card to
again cast his/her vote."

Abdul Aziz said using the biometric system would be the best solution,
instead of the indelible ink like in India and Indonesia.

Protestors and stoppers of Peaceful Assemblies are CRIMINALS

The constitution guarantees PEACEFUL ASSEMBLIES, even in the revised
paragraphs.
Anyone who try to protest or stop constitutional rights of citizens
are criminals.
Imagine someone making a protest report against someone who exercises
his voting rights. Even worse, Policemen or other bodies preventing
citizens from exercising their rights to vote. They are just bloody
criminals for stopping these voters.
Similarly for the peaceful assemblers. Anyone who make police reports
trying to deny their rights for peaceful assemblies deserve to be put
into prisons, similarly for policemen and judges who stop these
peaceful assemblies.
Policemen can stop assemblies that are not peaceful as clearly stated
by the constitution. How can you prove that the assemblies are not
peaceful if it has not started??? Similarly for the protesters of
peaceful assemblies. They are the ones who are proven to be breaking
the law and constitution by denying citizens their rights granted by
the constitution.
Some of the police reports, as reported by this article shows clearly
that these people who make police reports are against the constitution
by declaring that PEACEFUL ASSEMBLIES will affect their livelihood.
This include the highest officers in our county who deserve to be
jailed for disrespecting the constitution.
How can anybody be so sure that ANY ASSEMBLIES ARE NOT PEACEFUL even
before it has started!!!!
If you are sure that all assemblies will not be peaceful, it means
that YOU ARE AGAINST ANY PEACEFUL ASSEMBLIES, which is against the
constitution and deserve to be punished for disrespecting the
constitution, with the highest punishments. It does not matter if you
are the Prime Minister or Chief Judge. If you are against the
constitution, you must be punished, as DEMANDED BY LAW, AND
CONSTITUTION.
Malaysians!!! Please wake up. Don't be ANIMALS. Stop lying or being
hypocrites. Only animals, cannot be trusted with their words. Respect
the constitution and Rukun Negara.

Protest mounts as more reports are lodged against Bersih march
KUALA LUMPUR: Protests against the opposition-initated Bersih 2.0
rally continues to mount with at least four more police reports lodged
against the organisers, and the Deputy Prime Minister condemning it as
a plot to topple the Government.
This follows the stand taken by Bersih 2.0 chairman Datuk Ambiga
Sreenevasan that the coalition would proceed with the planned rally on
July 9 despite warnings by Deputy Inspector-General of Police Datuk
Seri Khalid Abu Bakar to arrest all illegal protesters.
The Malaysian Indian Muslim Congress (Kimma), Wira and Wirawati
Perkasa (the youth and women's wing of the Malay rights group) and the
Malaysian Veteran Armed Forces Association lodged separate reports
against the group at the Dang Wangi police station yesterday.
The latest police reports bring the number of reports lodged against
the demonstration so far to 422.
In KOTA KINABALU, Tan Sri Muhyiddin Yassin said the opposition agenda
was to create a hate campaign against the Government by raising issues
beyond Bersih's call for clean and fair elections.
"They are trying to use street demonstrations to create a hate
momentum against the Government to achieve their road to Putrajaya'
agenda,'' the Deputy Prime Minister said after opening the Beaufort
Umno division meeting yesterday.
Muhyiddin said the group was being used by Pakatan Rakyat parties to
create public anger against the Government so that when elections are
called, the people would reject the ruling Barisan Nasional.
He suspected the opposition would use Bersih to twist issues like the
increased price of goods and corruption as part of its agenda to wrest
Federal power.
On a plan by Umno Youth to have a counter-rally, Muhyiddin advised
movement leader Khairy Jamaluddin to reconsider it and take into
account the consequences of such rallies to the economy, peace and
livelihood of the people.

Only Parliament can restrict the freedom of Assembly according to the Malaysian Constitution

This constitution is very clear. There is a right to assemble
peacefully but parliament can subject it to restrictioins, but not to
the point of effectively denying the right of assembly.
It is just plain English. If you effectively deny this right by
allowing policemen to issue permits at will without just causes as
outlined by this constitution, this clause is null and void, making
the whole constitution invalid. It also does not comply with the
conditions of Malaysian UN membership.
The Police must justify that it is in the interest of the Federation.
Allowing the decision to be made by Policemen and plain magistrates
is just clearly against the wording of this constitution, making that
law invalid.
Since it is just not practical to allow Policemen and Judges to decide
on the security of the Nation, Only Parliament, as the highest
governing body can prevent a peaceful assembly and ONLY BY LAW.
The older versions of this article disallow even Parliament to
restrict the right for free speech and assembly, but now it is amended
so as to restrict these rights. However since the Freedom of Assembly
has to be written down first, the meaning of the first sentence,
overide any wordings after it.
You cannot just say, you have the right to freely eat anything on the
table, but I do not allow you to eat it.
This is just plain bad English. If judges can't even understand simple
and plain English language, also true for any language, they don't
have the right to be Judges.
We have stupid judges, which is for sure, based on past judgements by
the Federal courts, but we have no right to stop it at the moment
since most of the voters agree with these judgements by voting for the
BN governments that appoints these judges.
For Bersih to go against these Policemen who clearly violate the
constitution by not PROVING BEYOND DOUBT that the assembly is not
peaceful, SINCE THE ASSEMBLY has not even started, it is like
negotiating with Gangsters. You cannot win with arguments.
Why the need to go beyond reasonable doubt? because the constitution
demands it.
"all citizens have the right to assemble peaceably and without arms"
So they can assemble anytime then. But can be restricted,
ONLY "in the interest of the security of the Federation or any part
thereof, or public order"
That means you can assembly FIRST, and later to be judged if it is
against the security or public order.
This is what the English or any language, will mean if interpreted
with honestly and properly. Only bloody dishonest and crooked people
will interpret it any other way.
The intention of the BN government AND all voters who vote for it, is
to restrict the freedom of Assembly, but the only way you can do it,
is by removing the words, "Freedom of Assembly", once and for all, and
stop all these hypocrisies.

Voters must understand the consequences of removing the fundamental
principle of Democracy such as the Freedom of Assembly. It will mean
economic hardships. You may think that you have peace in return, but
look at natioins who restrict freedom of assembly versus DEVELOPED
nations, that ALLOW PEACEFUL ASSSEMBLY??? Who is MORE PEACEFUL!!!!

A lot of Malaysians like to argue that Malaysians are special. They
are superhumans. Unfortunately facts had proven them otherwise.
Malaysia is now a pariah nation with the worst economic well being
despite having such immense resources.
What Malaysians like to be proud of was past British era of
development, not the Malaysian era. During the Malaysian era, it was a
constant decline. With the removal of democracy, Malaysians will find
out how superhumans they are.
Article 10 of the Malaysian Constitution:
1 Subject to Clauses (2), (3) and (4) —
* (a) every citizen has the right to freedom of speech and
expression;
* (b) all citizens have the right to assemble peaceably and
without arms;
* (c) all citizens have the right to form associations.
2 Parliament may by law impose —
* (a) on the rights conferred by paragraph (a) of Clause (1), such
restrictions as it deems necessary or expedient in the interest of the
security of the Federation or any part thereof, friendly relations
with other countries, public order or morality and restrictions
designed to protect the privileges of Parliament or of any Legislative
Assembly or to provide against contempt of court, defamation, or
incitement to any offence;
* (b) on the right conferred by paragraph (b) of Clause (1), such
restrictions as it deems necessary or expedient in the interest of the
security of the Federation or any part thereof, or public order;

KEADILAN mengesali sikap kerajaan Umno Barisan Nasional (Umno BN)
Presidennya, Datuk Seri Wan Azizah Wan Ismail.
Menurutnya, ugutan Kementerian Dalam Negeri (KDN) mengesahkan Umno BN
kelancaran himpunan," katanya.
Beliau turut mengingatkan penentang BERSIH agar menghormati hak
"Maka, KEADILAN memastikan anggotanya turun beramai-ramai menyertai
